At Spectrum Tuition, families trust us with information about their children. We take that trust seriously. This policy explains what personal information we collect, why we collect it, how we look after it, and the choices you have.

1. Who this policy applies to

This policy applies to Spectrum Tuition Pty Ltd (ABN 13 151 285 522) and its related bodies corporate (“Spectrum Tuition”, “we”, “us” or “our”). It also applies to each Spectrum Tuition campus, including campuses operated under franchise. Each campus is responsible for the personal information it collects.

We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth).

This policy covers parents and guardians, students, people who enquire about or book our programs, people who visit our website, and people who apply to work with us.

2. The personal information we collect

About parents and guardians: name, phone number, email address, postal address, the campus and programs you’re interested in, and billing and payment records. Card payments are processed by our payment provider, and we don’t store full card numbers.

About students: name, date of birth or year level, school, the subjects and programs they’re enrolled in, assessment and quiz results, class work, progress notes and tutor reports, and any learning needs you choose to share with us.

Health information: medical conditions, allergies, medication needs and emergency contacts, which you give us at enrolment so we can keep your child safe. Health information is sensitive information under the Privacy Act, and we collect it only with your consent.

Photos, videos and testimonials: only with your consent. You can withdraw your consent at any time.

When you use our website and online tools: your device and browser type, pages visited, how you arrived at our site, and information from cookies and analytics tools. When you log in to Spectrum Navigator, our online portal, we also record which lessons and resources are used. If you chat with Nova on our website, we keep a record of the chat and any contact details you give.

About job applicants: your application, résumé, qualifications, academic results, referees, and the checks required to work with children, such as a Working with Children Check.

3. How we collect personal information

We collect most personal information directly from you, when you:

  • enquire about our programs or book a free assessment
  • complete an online assessment or enrolment form
  • call, email, message or visit us
  • attend classes, sit quizzes and assessments, or use our online tools
  • apply to work with us.

Parents and guardians usually give us information about their children. If you give us personal information about someone else, such as an emergency contact, please let them know.

If we receive personal information we didn’t ask for and don’t need, we’ll destroy or de-identify it where it’s lawful and reasonable to do so.

4. Dealing with us anonymously

You can make a general enquiry without telling us who you are, or by using a different name. To assess, enrol or teach your child, we’ll need your real details.

5. Why we collect and use personal information

We use personal information to:

  • assess your child and place them in the right class and level
  • deliver classes, student books, video lessons, quizzes and online tools
  • track progress and report to you, including posting weekly quiz results online
  • manage enrolments, re-enrolments, payments and term communication
  • keep students safe, including in a medical emergency, and meet our child safety obligations
  • answer your questions and respond to feedback and complaints
  • assess job applicants and manage our tutors
  • improve our programs, books and services
  • tell you about our programs, events and resources (see section 10)
  • meet our legal obligations.

We don’t use personal information for any other purpose unless you agree, or the law allows or requires it.

6. Online learning tools and AI

AI is not used in our classes. In class, students work on paper so their own thinking is visible.

Our AI study helpers, Tessa TutorBot (a talking video avatar) and Prism ChatBot, are on our online video lesson pages. They are optional and intended for use at home. Tessa TutorBot must only be used under the supervision of a parent, guardian or other adult. Students under 13 should only use Prism ChatBot with a parent or guardian present.

The AI tools are designed so that students don’t need to share any personal information, and we ask students never to enter their full name, school, address, phone number, email address or photos. The AI tools are not given student records, each session starts fresh, and they don’t remember previous conversations. Prism ChatBot conversations are deleted within 24 hours.

Nova, our website chat. Nova is the customer service chat on our website. It answers general questions about our programs and can help you book an assessment. We keep a record of your chat and any contact details you give, so our team can follow up. Please don’t share health or payment details in the chat. Nova is an AI assistant, and a member of our team can take over at any time.

Automated decisions. Our online assessment is scored automatically using your child’s answers to produce a report showing their level in each topic. Decisions about class placement are made by our educators, who review the report with you. We don’t make any decision about your child using AI alone.

7. Who we share personal information with

We don’t sell personal information. We share it only when needed to run our services, with:

  • service providers who help us operate, such as our customer management and messaging platform, payment processor, video hosting, online learning and AI service providers, and IT and data storage providers
  • the Spectrum Tuition campus your child attends, including a campus operated under franchise
  • your child’s tutors, so they can teach and support your child
  • emergency services or medical professionals in an emergency
  • government authorities and regulators when the law requires or allows it.

Our service providers may only use personal information to provide services to us, and must protect it.

We won’t share your child’s results or progress with their school, or anyone else outside Spectrum Tuition, without your consent.

8. Overseas storage and disclosure

Some of our service providers store or process personal information outside Australia, including in the United States. We take reasonable steps to make sure they protect it in line with the Australian Privacy Principles.

9. Testimonials, photos and recordings

We only publish a testimonial, photo or video of you or your child with your consent, and we only use the name you agree to. You can ask us to remove it at any time.

We do not record our online classes.

10. Marketing and how to opt out

We may send you emails or text messages about our programs, events and resources. Every marketing email includes an unsubscribe link, and you can reply STOP to a marketing text message. You can also contact us to opt out. We’ll still send you messages you need about an enrolment, such as timetables and invoices.

11. Cookies and website analytics

Our website uses cookies and analytics tools to understand how visitors use the site and to measure our advertising. Some of these tools are provided by third parties. You can turn off cookies in your browser settings, although some parts of the site may not work properly.

12. How we protect personal information

We store personal information securely, in password-protected systems with access limited to staff who need it. Paper records are kept in secure locations. Our tutors and staff are trained in handling student information.

If a data breach is likely to cause serious harm, we’ll notify the people affected and the Office of the Australian Information Commissioner, as the Notifiable Data Breaches scheme requires.

13. How long we keep personal information

Many families return to us over many years, with younger siblings or for later year levels. So we keep family and student enrolment records, such as contact details, enrolment history and results, after a student leaves. This makes re-enrolling simple and lets us see each child’s progress over time. You can ask us to delete these records at any time, unless we need to keep them by law.

We keep:

  • health information only while a student is enrolled, and we ask you to update it each time you re-enrol
  • financial records for 5 years, as tax law requires
  • records about child safety concerns for longer, in line with Victoria’s Child Safe Standards
  • unsuccessful job applications for 12 months, unless you ask us to delete them sooner.

When we no longer need personal information, we destroy or de-identify it.

14. Children’s information

Most of our students are under 18. We collect children’s information from their parent or guardian, and we communicate with parents and guardians about their child. A parent or guardian can ask to access, correct or delete their child’s information.

15. Accessing and correcting your information

You can ask to see the personal information we hold about you or your child, or ask us to correct it. Contact us using the details in section 16. We’ll respond within 30 days. There’s no charge to ask. If we can’t give you access, or don’t agree to a correction, we’ll explain why in writing.

We’ll acknowledge your complaint within 7 days and aim to resolve it within 30 days. If you’re not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

17. Changes to this policy

We may update this policy from time to time. The latest version is always on our website, with the date it was last updated.
