These terms apply when you enrol a student in classes with Spectrum Tuition Pty Ltd (ABN 13 151 285 522) and its related bodies corporate, including at campuses operated under franchise (“Spectrum Tuition”, “we”, “us” or “our”), and when you use our website and online tools. In these terms, “you” means the student and their parent or guardian.

By enrolling in classes at Spectrum Tuition, you agree to all of these terms. Nothing in these terms excludes or limits any rights you have under the Australian Consumer Law.

These terms are in two parts. Part A: Enrolment Terms (sections 1 to 8) applies when you enrol a student in classes. Part B: Website and AI Tools Terms (sections 9 to 12) applies when you use our website and online tools, including Nova, Tessa TutorBot and Prism ChatBot.

Part A: Enrolment Terms

1. Payment of fees

1.1 Tuition fees can be paid yearly, termly or weekly.

1.2 All quoted fees include GST.

1.3 Special prices and offers are quoted per student, per year and/or per term.

1.4 Fee payments are non-refundable. Payments for paid or pre-paid lessons that a student doesn’t attend are forfeited.

1.5 Spectrum Tuition may issue a credit note to a student at its sole discretion.

1.6 A credit is calculated as the fees paid, less the lessons attended and course materials, charged at the Weekly Rate. A $20 administration fee applies to all credit notes.

1.7 Credit notes cannot be exchanged for cash.

1.8 No further discounts apply to the Discounted Term Rate or the Yearly Rate.

1.9 Students receive an enrolment pass once their classes are paid in full.

1.10 Students must give their enrolment pass to their tutor to join a class.

1.11 Spectrum Tuition may change these terms, its payment rules and its fees or charges by giving written notice to the student and/or their parent or guardian.

1.12 Spectrum Tuition may cancel any or all classes at any time during the year. If we do, we will refund the fees for the cancelled classes.

2. Term fees

2.1 Term rates are set out in our Schedule of Fees, available on our website and on request.

2.2 The Discounted Term Rate applies only to students who pay in full by the first day of each term.

2.3 If payment is not made by the first day of term, the Regular Term Rate applies to payments made during the term the student attends. Payments made after that term are charged at the Weekly Rate.

3. Yearly fees

3.1 Yearly payments must be paid in full by the last day of Term 1 of the calendar year in which the student enrols.

3.2 If the yearly payment is not paid in full at enrolment, Term 1 fees are required as a deposit towards it.

4. Super Early Bird Term Rate

4.1 The Super Early Bird Term Rate is available only to current Spectrum Tuition students who pay in full by the last day of the term before the term they are enrolling in.

4.2 If that deadline is missed, the Discounted Term Rate or Regular Term Rate applies to payments made during the term the student attends. Payments made after that term are charged at the Weekly Rate.

5. Non-payment

5.1 Spectrum Tuition may suspend classes or services to a student for non-payment, at its absolute discretion.

5.2 Unpaid fees and charges owed by the parent, guardian and/or student may be referred to a debt collection agency.

5.3 The parent or guardian must pay all fees, charges and reasonable costs of collecting outstanding amounts.

6. Illness and medical attention

6.1 Full details of the student’s medical conditions and history must be provided at enrolment, and updated whenever they change.

6.2 If a student is injured, has an accident or becomes ill while under Spectrum Tuition’s supervision or care:

6.2.1 Spectrum Tuition will try to notify the parent or guardian as soon as reasonably practicable, and will try to obtain their consent before seeking urgent medical treatment for a student under 18.

6.2.2 If consent cannot be obtained for any reason, and Spectrum Tuition or its staff consider medical treatment necessary, the parent or guardian agrees to pay all expenses of that treatment.

7. Supervision

7.1 Spectrum Tuition will take reasonable care of students while they are under its care or supervision.

7.2 To the extent permitted by law, the parent or guardian acknowledges that Spectrum Tuition is not liable for any damage, accident, injury, loss, expense or liability arising from classes or activities while the student is under its supervision.

7.3 The parent or guardian agrees to pay Spectrum Tuition for any damage, injury, loss, expense or liability the student causes to public or private property.

8. Indemnity

8.1 To the extent permitted by law, the parent or guardian releases, indemnifies and defends Spectrum Tuition against all claims, liabilities, losses, suits and expenses, including costs and reasonable legal fees, brought by anyone (including a co-participant, a third party, the student, their parent or guardian, or any family member) arising from any injury, damage or loss connected with the student’s enrolment, participation, or use of Spectrum Tuition’s services, equipment, tuition, facilities or materials.

Part B: Website and AI Tools Terms

By using our website and online tools, you agree to Part B of these terms.

9. Online learning tools and AI

9.1 Online tools. Enrolment includes access to Spectrum Navigator, our online portal, and to the AI study helpers on our online video lesson pages, Tessa TutorBot (a talking video avatar) and Prism ChatBot, while fees are paid. Spectrum Tuition may change, update or withdraw these tools at any time.

9.2 No AI in class. Classes are taught on paper. AI tools are not used during Spectrum Tuition classes.

9.3 Optional, at home. Tessa TutorBot and Prism ChatBot are optional and intended for use at home. Tessa TutorBot must only be used under the supervision of a parent, guardian or other adult. Students under 13 must only use Prism ChatBot with a parent or guardian present.

9.4 Personal information. Students must not enter personal information into any AI tool, including their full name, school, address, phone number, email address or photos. Parents and guardians agree to supervise their child’s use of the AI tools.

9.5 Accuracy. AI responses can be wrong. The AI tools are a study aid only and do not replace a tutor, a teacher or the student’s own thinking. Students should check any response before relying on it.

9.6 School work and assessments. Students must not use Spectrum Tuition’s AI tools to produce work they submit as their own at school, including VCE school-based assessments. Students must follow their school’s and the VCAA’s rules on AI.

9.7 Acceptable use. Students must not use any Spectrum Tuition online tool to share harmful or offensive content, to try to get around the tools’ safeguards, or to share their login details with others.

9.8 Nova. Nova is the customer service chat on our website. It answers general questions and can help you book an assessment. Answers from Nova are general information only; your enrolment is governed by these terms and our Schedule of Fees. Please don’t share health or payment details in the chat. Nova is an AI assistant, and a member of our team can take over at any time.

9.9 Suspension of access. Spectrum Tuition may suspend or remove access to online tools if they are misused or fees are unpaid.

9.10 Online classes. We do not record our online classes.

9.11 Reliance on AI. Subject to your rights under the Australian Consumer Law, Spectrum Tuition is not liable for any loss arising from reliance on a response from an AI tool.

10. Course materials and website content

10.1 Student books, video lessons, worksheets, quizzes and other materials, and the content of our website, are owned by Spectrum Tuition or its licensors.

10.2 Course materials are for the enrolled student’s personal use only. They must not be copied, shared, sold or uploaded to any website or service.

10.3 We take care to keep our website accurate, but programs, timetables and fees can change. Please check with your campus before you enrol.

10.4 Our website may link to other websites. We are not responsible for their content or how they handle personal information.

11. Privacy

11.1 We collect, use and protect personal information in line with our Privacy Policy at spectrumtuition.com/privacy-policy.

12. General

12.1 These terms are governed by the laws of Victoria, Australia.

12.2 If any part of these terms is found to be invalid or unenforceable, the rest of the terms still apply.
